Our client, a Lithuanian transport company has participated in a car collision in France. The responsible for the accident was a French citizen who drove a Volkswagen car. The driver, working in our client’s company drove a truck SCANIA R440 with KRONE trailer. The culprit had third party liability insurance, so the drivers filled out European Accident Declaration form. There were no injuries, so the declaration form was enough to handle the case. The damaged truck was examined by a Lithuanian expert and the repair expenses were compensated under CASCO insurance. The suffered company realized that the repair expenses were only a part of the incurred loss: damaged vehicle will be standing in a repair shop and will not make any profit. The company had no possibility to change the damaged vehicle to another one. Our client decided it would take too much time handling this case without an expert and therefor approached to us. We have estimated that because of the accident, our client has lost almost 3000 EUR profit - the damaged vehicle could not make any profit whilst standing in the repair shop. According to the experts’ report it would take 13 work days to repair the vehicle.
After a long negotiation with the insurance company of the responsible party, we have finally received the agreement to compensate loss of profit for the Lithuanian transport company.
