We are handling in the name of insurance companies in recourse cases all over the Europe. What do we call a recourse case? The insurer (insurance company) compensates the loss to their policy holder and gains a right to claim a responsible for the accident party or its’ third party liability insurance company. This is process is not always easy: if the responsible party is located in another country we may face communication problems, moreover the legal basis differs from country to country, starting from limitation period for the claim to the specific terms on making decisions. It might be wise to trust professionals.
Let’s see the example from our practice:
Our client, a Belorussian insurance company has compensated the loss to their client after their trailer Schmitz was damaged in Belarus. Both insurer and the policy holder were located in Belarus too. Meanwhile, the responsible for the accident was Lithuanian driver, working Lithuanian transport company and insured in a insurance company, located in Lithuania. The driver was not careful enough while parking his DAF truck with trailer KRONE and hit the Belorussian Schmitz trailer. Our client made a choice and asked us to handle the case. After the successful communication and negotiation with the insurance company of the responsible for the accident party has compensated trailers’ repair expenses and agreed on settling the case.
